Second lawsuit against KD begins

The hearing of the second lawsuit filed against KD Ahmed Manik, Commissioner of Elections by Maldivian Democratic Party MDP was held yesterday at the Civil Court. MDP alleges that during the recent public referendum on system of government, KD Ahmed Manik, Commissioner of Elections had issued the list of eligible voters’ differently on different occasions and had included names of deceased people in the list.

At yesterday’s hearing Attorney to MDP Hisan Hassan raised two important issues.

She asked the Judge whether the absence of KD Ahmed Manik is acceptable to court as the law suit is about failure to discharge of his assigned duties and whether the state can be answerable to court for his alleged wrongdoings.

State Attorney Moosa Haleem on behalf of KD Ahmed Manik replied that under the present constitution Commissioner of Elections is not a free and independent party, moreover as the lawsuit was not against an individual, the state has the right to defend a government institution.

MDP’s case against KD Ahmed Manik is to prove to court that referendum was carried out in violation of its regulation A, clause 3. MDP alleges that KD Ahamed Manik had violated the regulations governing the referendum by including a large number of deceased people in the list of eligible voters, and by providing a list of eligible voters that contradict house registries as names of persons have been listed under different houses many times and some of the eligible voters names were omitted from the list.

State Attorney Moosa Haleem pointed out that lawsuit filed against KD Ahmed Manik is the same as the case filed against his client previously and requested the court to make 2 lawsuits to combine them. However MDP Attorney insisted that 2 lawsuits were different.

On closing yesterday’s session Judge Aishath Sujoon said she will schedule another hearing of the case soon.
