Article 4 of the Bill on Rights and Freedom of the revised Constitution if passed as proposed by the Member for Gaafu Dhaalu Atoll Abbas Ibrahim will provide the government the opportunity to exploit the rights and freedom of the people in the name of religion says the Chairman of the Drafting Committee of the Special Majlis.
Speaking to Velidhoo News Ibrahim Ismail if the amendment was accepted by the Majlis it will provide the opportunity for the judges and magistrates to issue different verdicts on a certain type of cases.
Article 4 of the revised constitution deals with rights of the people to engage in activities that are not prohibited by the constitution. Abbas Ibrahim proposes to add the words Islamic Sharia which then read the rights of the people to engage in activities that are not prohibited by Islamic Sharia and the constitution.
Special Majlis failed to achieve a consensus on the proposed amendment. Some members are of the opinion the amendment as proposed would not create any problems while other members that entire draft of the constitution reflects many un Islamic characteristics and fears that, if the draft constitution is passed as proposed by the drafting Committee, Islamic religion will soon be erased from the country.
Ibrahim Ismail Chairmen of the Drafting Committee does not agree.
A constitution which paves the way for the dissolution of Islamic religion from the country would not be accepted by the people, it is not our desire, I think some members didn’t fully appreciate what is said in the draft said Ibrahim Ismail.
He further said that he did not support the amendment as would it would lay everything in the hands of the judges or the magistrates.
Considering our recent past, we have instances where the rights of the people were denied in the name of Islamic Sharia, such as the right an attorney said Ibrahim Ismail, Chairmen of the Drafting Committee.
The article 4 of the Bill on Rights and Freedom was drafted with a view to disallow such violations from being repeated said Ibrahim Ismail.
